Erxleben ordered to jail for contempt of court

AUSTIN (AP) -- Former University of Texas kicker Russell Erxleben faces up to six months in jail for contempt of court.

A judge found Erxleben guilty of impeding efforts to recover assets from his failed foreign currency trading firm.

Erxleben failed to fully respond to nine court orders over the past year and a half as the courts tried to recover assets from Austin Forex International Inc., the Austin American-Statesman reported Thursday. Assets are to be liquidated and returned to investors.

Those efforts were stymied by Erxleben's failure to report items such as Rolex watches, rings, savings bonds and promissory notes purchased with company funds.

"You messed around with the assets in ways you shouldn't have," Judge Paul Davis said during Wednesday's hearing.

The court also found that Erxleben improperly withheld and cashed savings bonds bought by his failed company and withheld information about a bank account held by his wife.

Erxleben said he didn't believe some of the contested items were assets of the company but were purchased with personal money that had gone through company accounts.

Erxleben was ordered to report to the Travis County Jail on Monday. His attorneys said they would appeal the ruling before then. The contempt judgment carries a six-month jail sentence and about $400 in fines.

Erxleben pleaded guilty in November in federal court to conspiracy and securities fraud involving hundreds of investors who lost about $34 million.

Erxleben, who was a kicker for the Longhorns and the New Orleans Saints in the National Football League, faces up to seven years in federal prison. He is to be sentenced Sept. 17.
